If a private landlord uses false information to get you to leave
You can apply for compensation if your landlord either:
- misleads you into moving out
- misleads the tribunal into granting an eviction order
This is called wrongful termination.
You can get compensation of up to 6 months’ rent.
When you can apply for compensation
You can only apply if:
- you had a private residential tenancy
- your landlord sent you a notice to leave
Example of wrongful termination
Your landlord sent you an eviction notice saying they were selling the property. You then moved out.
They do not sell the property and rent it to a new tenant instead.
How to apply to the tribunal
Use form G (General Private Tenancies Application) and rule 110. Get form G from the tribunal website.
You’ll need to send the tribunal:
- a copy of your private residential tenancy agreement
- a copy of the notice to leave
- any evidence you have about being misled
There’s no cost to apply to the tribunal.
Going to a tribunal hearing
The tribunal will consider both sides of the case. It will decide whether your landlord misled you into moving out.
At a tribunal hearing, you can:
- represent yourself
- have someone go with you to support you or speak on your behalf
