If you do not move out at the end of the notice period
If you do not move out, your landlord must apply for an eviction order at the First-Tier Tribunal for Scotland (Housing and Property Chamber).
They can only apply when all the following apply:
- you or the landlord gave notice to end the tenancy
- you’ve not moved out by the end of the notice period
- less than 6 months have passed since the notice period ended
Going to a tribunal hearing
The tribunal will consider both sides of the case and decide whether evicting you is reasonable.
You can represent yourself at the hearing or have someone accompany you to support you or speak on your behalf.
If you would like legal advice and representation
Getting legal advice and representation can help you keep your home and challenge the eviction at the tribunal.

You can also get legal advice from a solicitor. If you’re on a low income you may qualify for legal aid.
