Property factor complaints

If you believe your property factor has not met the terms of your written statement or any part of the code, you can make a complaint to them.

Every factor must have a written complaints process.

Making a complaint

Follow your factor's complaints process. Make your complaint in writing and keep copies of all correspondence and documents.

If you’re not satisfied with the outcome, you can apply to the First-tier Tribunal for Scotland (Housing and Property Chamber).

The Scottish Government cannot step in or resolve disputes. This includes the register team.

Applying to the housing tribunal

Complete form C2 (Property factor application).

If the issue you’re complaining about happened before 16 August 2021, use form C1 instead.

The tribunal will only accept your application once you’ve completed your factor's complaints process.

What to include

You must include the following documents with your application:

  • copies of your complaints
  • any responses you got to your complaints
  • a copy of your statement of services, if you have one
