Applying for voluntary removal from the register

You can apply for voluntary removal if you've stopped providing factoring services.

When to apply for voluntary removal

You should apply when you have:

  • retired or closed your business
  • sold your factoring portfolio or transferred operations to another registered property factor
  • merged or restructured your business and no longer provide factoring services
  • changed your business model and no longer operate as a factor

When not to apply

You should not apply for voluntary removal when:

  • you're still carrying out any property factor work, even at a reduced scale
  • a fit and proper test is still being assessed
  • you have ongoing or unresolved tribunal cases
  • you have outstanding requirements from a Property Factor Enforcement Order
  • your business has already legally ceased to exist – in this case the Scottish Government may remove you separately
  • your business has been purchased but continues to operate as the same legal entity – you need to tell the register team about a change of circumstances by emailing propertyfactorregister@gov.scot

How to apply for voluntary removal

Information you need to apply

To complete the application form, you need to give:

  • the reason you're applying for removal
  • the date you stopped or will stop providing factoring services
  • a list of properties you managed at the point you stopped providing factoring services
  • details of how homeowners were notified
  • information about any transition arrangements
  • details of any new factor appointed
  • information about any ongoing or recent tribunal cases
  • a signed declaration confirming that the information provided is accurate

After you apply

The register team will review your application. If it is approved:

  • you'll be removed from the Property Factor Register
  • your entry on the public register will show the date your registration ended
  • you must not carry out property factor work after the removal date, unless you submit a new application and it is approved
