Rent increases if you have a regulated tenancy

If you have a regulated tenancy, your landlord can only increase the rent if you agree to it in writing.

If you do not agree, your landlord must apply to have the rent registered as a fair rent.

They can only register a new fair rent for the property once every 3 years.

If you do not accept the fair rent

If you do not accept the fair rent, you can take your landlord to a tribunal. The tribunal is called the First-tier Tribunal for Scotland (Housing and Property Chamber).

The tribunal will decide if the fair rent is too high.

There’s no cost to apply to the tribunal.
