Applying for a review of convictions on your disclosure

You can apply to have certain convictions reviewed by Disclosure Scotland. This means they can consider whether to remove them from your disclosure.

You can apply to have a spent conviction reviewed if it's:

  • List A offence and it's at least 11 years since the conviction date, or
  • List B offence and it's less than 11 years since the conviction date

Warning

If you apply for a review and it's successful, the information will only be removed from your disclosure. This review process does not remove information from your police record.

How to apply for a review

1. Check your disclosure

If you have convictions eligible for review there will be a notification at the top of your disclosure. The eligible convictions will also be highlighted.

2. Decide if you want to apply

There will be information on your disclosure to help you decide whether to apply for a review. Contact Disclosure Scotland if you need more help:

3. Complete the application form

If you decide to apply for a review, you’ll need to complete an application form.

You’ll have 10 days to decide whether you want to apply for a review, starting from when you were sent your disclosure.

4. Send additional information (optional)

You’ll have the opportunity to send more information to help Disclosure Scotland make a decision. For example, you may want to tell them about the context of your convictions.

You’ll have 28 days to send more information, starting from when you applied.

5. Review the decision

Disclosure Scotland may contact you for more information, or they may need to verify some of the information you give.

Once they have completed their review they will send you an email with their decision. If they decide to remove the eligible convictions, you’ll get a new disclosure.

If they decide not to remove them, you’ll be told why. If you disagree with the decision, you’ll have the opportunity to appeal to an independent reviewer.

Other Relevant Information (ORI)

There's a different process if you want to apply for a review of Other Relevant Information (known as ORI). ORI is information that the police have added to your disclosure.

You'll need to complete an application form and send it to Disclosure Scotland. They will send it to the relevant police force who will review it and make a decision.
