Insurance for tenement common areas

You must have insurance that covers your share of common areas. For example, through your building insurance.

This means that if the tenement needs to be rebuilt, you can contribute.

You are only properly insured if every other owner in the tenement has the correct insurance too.

Checking if other owners are insured

You have the legal right to ask other owners for evidence that:

  • they’re insured to the full reinstatement value, meaning the cost of rebuilding the tenement
  • all their premiums are fully paid

You must request this in writing. The owner must give you evidence within 14 days.

If an owner is not fully insured

If an owner is not properly insured, you can apply to the sheriff court to force the owner to get insurance.
