If your property does not meet the repair standards
You must:
- repair the property so it meets the repair standards
- follow rules for getting access to do repairs
- do the repairs in a reasonable amount of time
- pay for the repairs, unless damage was specifically caused by the tenant
The tenant must report repair issues to you. This is so that you can investigate and get repair work done.
If you fail to do the repairs
Your tenant can take you to a tribunal. It's called the First-Tier Tribunal for Scotland (Housing and Property Chamber).
The tribunal can inspect the property to check if it meets the required standards. If it does not, the tribunal can give you a Repairing Standard Enforcement Order. This tells you what repair work to do, and when you must do it by.
It’s a criminal offence to ignore a Repairing Standard Enforcement Order.
