Applying for an eviction order if the tenant does not move out
You can only get an eviction order when all the following apply:
- you’ve given your tenant notice to end the tenancy or they gave you notice
- they’ve not moved out by the end of the notice period
- less than 6 months have passed since the notice period ended
To get an eviction order, you apply to the First-Tier Tribunal for Scotland (Housing and Property Chamber).
The tribunal will consider both sides of the case and decide if it’s reasonable to evict your tenant.
How to apply to the tribunal
Complete a form E (Eviction Application) and send it to the tribunal. Get form E and notes for completing it on the tribunal’s website.
You’ll need to send the tribunal a copy of the written notice to leave that you gave the tenant.
There is no cost to apply to the tribunal.
Tell the local council you plan to evict the tenant
You must tell the local council that you’re taking action to evict your tenant. To do this, complete a section 11 form and send it to your council.
This tells the council the risk of the tenant becoming homeless.
