Check the 'burdens' section. The term 'manager' or 'managing agent' might be used. These types of burdens are known as 'manager burdens'.

Do they explain when the burden ends?

For example, by giving an end date or a set of conditions that end the burden.

Manager burdens last a maximum of 30 years, starting from the date of the first sale of any of the homes.

Not including a warden's flat.

It will be if your home or any of the other homes were first sold more than 5 years ago.

Does the developer still own any of the homes?

For example, new build homes or flats that they've still to sell.

Does the council or housing association still own any of the homes in your tenement or building?

You may not be able to dismiss your property factor

If your deeds do include a manager burden, you cannot dismiss your property factor unless the burden ends or has already ended.

Unless the burden has ended, you can only dismiss your property factor if a majority of homeowners agree to it.

This will only be possible if a majority of the homes in your building or tenement have been sold.

You may have more options to appoint or dismiss your factor when the manager burden ends.

When does a manager burden end?

A manager burden automatically ends after 30 years for ex-council or housing association homes sold under Right to Buy.

At any point during the 30 years, the burden will end as soon as either:

  • the council or housing association no longer owns any of the homes in your housing development 
  • any other conditions your deeds say end the burden are met

Once a manager burden has ended

You'll have more options to appoint or dismiss a property factor.
