If your tenancy deposit was not protected
Unless they’re exempt, your landlord must use a tenancy deposit scheme.
If they do not, you can take your landlord to the First-Tier Tribunal for Scotland (Housing and Property Chamber).
What the tribunal can do
The tribunal can order your landlord to:
- protect your deposit if you still live there
- return your deposit if you’ve moved out
- pay you compensation of up to 3 times the deposit amount
When you can apply
You can apply either:
- during the tenancy
- up to 3 months after your tenancy ends
How to apply to the tribunal
Use form G (General Private Tenancies Application) and rule 103 to apply. Get form G and notes on completing it on the tribunal website.
You’ll need to send the tribunal a copy of your tenancy agreement when you apply.
There’s no cost to apply to the tribunal.
