Disputes with a resident on a mobile home site

You can get help to resolve a dispute with a resident.

If you’re not following the terms of your site licence, residents can report this to the local council.

Some problems can be solved by discussing them with residents or with a residents’ association. If there’s a residents’ association, they can get advice from the Scottish Confederation of Park Homes Residents Association.

Getting mediation

If you’re a member, you can get mediation support from the British Holiday and Home Parks Association.

They cannot decide for you, but they can help you reach an agreement in a dispute.

There are other steps you can take to avoid going to court.

Taking legal action

In certain circumstances, you can take legal action to resolve a dispute.

You can apply to the sheriff court if a resident:

  • does not follow the terms of the written statement
  • does not live onsite as their only or main home
  • does not do necessary repairs on their home that is affecting the rest of the site
  • does not pay their pitch fees

The court can order the resident to do repairs or pay what they owe.

It can also take away the resident's right to keep their home on your site.
