If you got a rent increase notice before 6 September 2022
If you were given a rent increase notice before 6 September 2022, it will still be valid as long as your landlord has given you:
- the correct type of rent increase notice for the type of tenancy you have
- the correct amount of notice for the type of tenancy you have, and followed all other rules set out in law for rent increases for that type of tenancy
You can find out more about the rules that apply to rent increase notices served before 6 September 2022.
Depending on what type of tenancy you have, you may have a right to challenge a rent increase by applying to Rent Service Scotland or to the First Tier Tribunal.
Your landlord can increase your rent once every 12 months if you have a Private Residential Tenancy or an assured tenancy covered by the rules on rent increases in the Housing (Scotland) Act 1988.
