Terms and Conditions - mygov.scot app

These Terms and Conditions set out the terms under which you may access and use the mygov.scot app. Please read them carefully and make sure you understand them.  

Information about us 

The mygov.scot app is provided by the Scottish Government. Our legal identity is ‘Scottish Ministers’ and will be referred to as ‘we’ in these terms and conditions. 

Definitions 

  • ‘mygov.scot app’ is the name of the app provided by the Scottish Government. It refers to both the mobile app and the web app (see below). 
  • ‘ScotAccount’ is the name for the individual digital identity services provided by the Scottish Government. 
  • ‘ScotAccount Service’ means any digital identity services provided by the Scottish Government to you, including registering for a ScotAccount, Sign On, and Verify Your Identity. 
  • ‘mobile app’ refers to the version of the mygov.scot app downloadable from the App Store and Google Play. 
  • ‘web application’ refers to the version of the mygov.scot app that you can sign in to on a web browser. 
  • ‘sign in’ refers to the process by which you can register for the mygov.scot app and subsequently access it. 
  • ‘verified’ means a ScotAccount that has gone through the ScotAccount Service which enables you to confirm your identity to a Service Provider, using official documentation (your passport, UK driving licence or UK biometric residence permit). 
  • ‘unverified’ means a ScotAccount that has not gone through the ScotAccount Service which enables you to confirm your identity to a Service Provider, using official documentation (your passport, UK driving licence or UK biometric residence permit). 
  • ‘Digital Mailbox’ means the Scottish Government’s digital mailbox. 
  • ‘Service Provider’ means any Scottish public body which provides services to the public and which has agreed to partner with the mygov.scot app to provide access to their services. 

Your acceptance of the Terms and Conditions 

Mobile app 

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur from when you click “Accept Terms and Conditions” when you first sign in to the app. If you do not agree to comply with and be bound by these Terms and Conditions, you must click “Decline Terms and Conditions” and stop using the mygov.scot app immediately. 

Web application  

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur when you continue to sign in after being presented with them. If you do not agree to comply with and be bound by these Terms and Conditions, you must not sign in and not use the mygov.scot app. 

Updating the Terms and Conditions 

We can update these Terms and Conditions at any time without notice. You should check them regularly to see if they’ve been updated. You can access them from the app.  

Your continued use of the mygov.scot app after these Terms and Conditions have been updated will constitute your acceptance of them. 

Personal data & privacy 

We respect your privacy and we are committed to protecting your personal data. You can find information about how we collect, process and protect your personal data in our Privacy Notice.  

By using the mygov.scot app you acknowledge that we will collect personal information about you in accordance with our Privacy Notice.  

Your use of the mygov.scot app 

You need to have a ScotAccount to sign in and use the app. You should read the ScotAccount Terms of Use.  

We may automatically update the mygov.scot app regularly. We can change or remove content or the app itself at any time without notice. Alternatively, we may ask you to update the mygov.scot app on your device. If you choose not to install such updates, or opt out of automatic updates, you may not be able to continue using the mygov.scot app. 

You can contact us by email if you: 

  • want to learn more about the mygov.scot app or have any problems using it 
  • think the mygov.scot app is faulty or misdescribed

Your identity does not need to be verified in ScotAccount to use the app, but unverified accounts may not be able to use some services available on the app. 

You assert that all information you submit to us is accurate and authentic to the best of your knowledge. 

It’s important you use the mygov.scot app securely so that our services are not used improperly. 

Limitations of use 

You may use the mygov.scot app for lawful purposes only. You must not use the app in any way that causes, or is likely to cause, the app or access to it to be damaged or interrupted in any way. 

You must not use the app: 

  • to transmit any material that is unlawful, harassing, libellous, defamatory, racially offensive, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable 
  • to collect or harvest any data or attempt to decipher any transmissions to or from the servers running mygov.scot app 
  • in a way that could damage, disable, overburden, impair or compromise our systems or security 
  • in a way that interferes with other users 
  • in any unlawful or fraudulent manner or for any unlawful or fraudulent purpose 
  • in a manner that is improper use or inconsistent with these terms and conditions 
  • to gain or attempt to gain unauthorised access to the mygov.scot app platform, the server on which the platform is stored or any server, computer or database connected to the mygov.scot app, by hacking or other means 
  • to transmit, send or upload any data that contains viruses, Trojan horses, worms, spyware or any other harmful programs designed to adversely affect the operation of computer software or hardware 
  • in connection with any kind of denial of service attack or for any malicious purpose 
  • take any other action which could reasonably be considered harassment, abuse or malicious, disruptive, fraudulent or criminal behaviour 
  • with someone else’s registered details, unless you have the authority to do so from them 

Improper use of the mygov.scot app that breaches these terms and conditions may lead to your ScotAccount being suspended or deleted and end your right to use the mygov.scot app. 

If we end your rights to use the mygov.scot app, you must: 

  • stop using the mygov.scot app, including any activities authorised by these terms  
  • delete or remove the mygov.scot app from all devices in your possession 
  • immediately destroy all copies of the mygov.scot app which you have and confirm to us that you have done this 

Our obligations to you 

We will provide access to the mygov.scot app in accordance with these Terms and Conditions. 

We try to make sure that: 

  • you can use the mygov.scot app without interruption 
  • information transmitted in the app is free of errors 

Because of external factors this cannot be guaranteed.  

Access to the mygov.scot app may be suspended or restricted temporarily so we can: 

  • make repairs 
  • do maintenance  
  • introduce new services or functionality 

We try to limit the number and length of such periods as much as possible. 

We try to maintain the accuracy of the information on the app. We disclaim any warranty or representation, express or implied, about accuracy, completeness or appropriateness for a particular purpose. 

Get professional or specialist advice before you act based on any content in the mygov.scot app. We do not publish advice. 

Our liability to you 

We exclude all liability arising from or in relation to your use of the mygov.scot app in so far as permitted by law. In no circumstances shall our liability under or in relation to the Terms and Conditions exceed ONE HUNDRED POUNDS (£100) STERLING. 

We’re not attempting to exclude or limit any liability that we cannot limit or exclude under Scots law including (without limitation) liability for: 

  • death or personal injury arising from our negligence 
  • fraud or breach of statutory duty 

We may amend the mygov.scot app at any time without liability to you. We will try to give you as much notice as we can, but this may not always be possible. 

We have no liability for any third-party service or website that you may access using the mygov.scot app. We’re not responsible for:  

  • their content  
  • their functionality 
  • protecting any information you give them  
  • any loss or damage that may happen as a result of you using these services or websites, or any websites they link to 

By accepting these Terms and Conditions you agree to release us from any claim or dispute that may happen as a result of you using these services and websites.

Indemnity 

You agree to indemnify us against all claims, damages and expenses arising out of any breach of these Terms and Conditions, and any other liability arising out of your use of the mygov.scot app. 

Copyright and content re-use 

Find out what copyright laws apply to content and how to reuse content on the mygov.scot website.  

Asking to remove content 

You can contact us to:  

  • ask us to remove content on the mygov.scot app 
  • explain why you think it should be removed 

Content will be removed: 

  • to comply with data protection legislation covering the rights and freedoms of individuals 
  • if it breaches copyright laws, contains sensitive personal data or material that may be considered obscene or defamatory

We will decide if it needs to be removed and let you know our decision.  

Cancellation 

You can uninstall and stop using the mygov.scot app at any time. This will not delete: 

  • your ScotAccount 
  • the preferred name you provided when you accessed the mobile app for the first time 

Your preferred name is saved in the technology which powers the mygov.scot app and other Scottish Government digital services, like Digital Mailbox. To remove all of your data, including your preferred name, from all Scottish Government services, you must request for your ScotAccount to be deleted.

If you breach these Terms and Conditions we reserve the right to refer your ScotAccount to the ScotAccount team. This may result in your ScotAccount being suspended or deleted. If this happens you may not be able to use your ScotAccount to access other services.  

If you think your ScotAccount has been suspended or deleted in error, contact the ScotAccount team. 

We may take action to enforce these Terms and Conditions and take other action as appropriate where we have suffered loss. We have the right to refer any fraudulent or otherwise illegal activity, as well as any activities which reasonably raise suspicion of any such illegal activity, to the relevant authorities. 

If your use of the mygov.scot app is suspended or deleted for any reason, we shall delete all personal data in the app except if, and to the extent that, we are required to keep relevant records for compliance purposes in accordance with applicable law and our Privacy Policy. 

General 

These Terms and Conditions are governed by Scots law and the Scottish Courts shall have non-exclusive jurisdiction.
